BOCW

The BOCW refers to the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996 in India. 1. WHAT IS BOCW?

The Building and Other Construction Workers Act (BOCW) was introduced to regulate the employment and working conditions of construction workers and to ensure their safety, health, and welfare. The Act covers workers involved in building and construction projects such as residential buildings, roads, bridges, and other infrastructure projects.

The act also establishes BOCW Welfare Boards at the state level, which are responsible for registering construction workers and extending various welfare schemes to them.

2. CRITERIA FOR BOCW REGISTRATION

The registration process under the BOCW Act is primarily for construction workers (often daily wage workers) and employers involved in construction activities. The eligibility criteria vary slightly for workers and employers:

For Construction Workers:

• Age: Workers must be between 18 to 60 years old.
• Type of Work: The worker must be engaged in building or construction-related activities, such as masonry, carpentry, electrical work, plumbing, etc.
• Duration of Work: Workers must have worked for at least 90 days in the preceding 12 months** in construction or related work to be eligible for registration.

For Employers (Contractors/Builders):

• Any employer employing 10 or more workers in building or construction work must register under the BOCW Act.
• Employers must ensure compliance with the Act, which includes ensuring the safety and welfare of the workers on their construction sites.
• They are required to pay a cess (1-2%) of the construction cost as per the BOCW Cess Act, 1996.

3. PROCESS FOR BOCW REGISTRATION

For Construction Workers:

The registration process for construction workers involves the following steps:

The worker needs to fill out the BOCW Worker Registration Form. This form is usually available At The Local Labor Office or The Office of The Bocw Welfare Board in Each State.
